During investigation, cops have found that he uploaded some videos on internet and also got few such videos from other internet users. Cops are alsodoubting that the pedophile foreigner can be a part of some international gang involved in child porn. Sleuths are also doubting that Ward targeted kids in Burma where he resided for two years due to official work[2]. His chat shows that he not only was in touch with kids from the blind school but also in touch with other kids of different area. He used to initiate conversation by asking whether they have any close friends and their views about sex,” a police official investigating the case told The New Indian Express. “As we have found various clips and conversation with other internet users, exchange of videos and photos on WhatsApp, we are also probing whether he was a part of some international racket or not who deals in child porn on the internet,” official added. Cops are claiming that his phone has photos and video since November 2016 after he returned from Burma. He had gone to Burma for two years on some project from office. While Indian Express has been giving these extra details, others have been repetitive of what the PTI have brought out.

Why Chastity consciousness is not there in the pedophile issue?: None has noted that any TV channel has ever discussed the pedophile crime during their debates. The vernacular TV channels may not know the issue at all or knowing suppressing the facts. As usual, the media, human rights activities, child rights saviors, the opinion making and decision taking elites and authorities, and whole range of protesters, activists and others have been silent on this issue as usual. While Gauri and Anita have been sensational in Bangalore and Chennai, none bothered to recognize them among the unfortunate defiled and raped 34. Of late, the mob psychology of the protesters has been intriguing and strange, as they become excitingly proactive, highly charged and exceedingly emotional for some issues, whereas, they virtually ignore other very important, burning and more affecting issues, problems and malices. Ironically, pedophile has been neglected and ignored by most of all.

Delhi High Court directs AAP Government to ensure safety of visually impaired minors (08-09-2017)[3]: The Delhi High Court today asked the AAP government to ensure safety of children, some of whom were allegedly sexually assaulted by a British national at the National Association for the Blind (NAB) here. A bench of Acting Chief Justice Gita Mittal and Justice C Hari Shankar also issued notice to the Delhi government and the police station concerned and sought status report on the issue by September 12, 2017. The bench asked the Delhi State Legal Services Authority (DSLSA) member secretary to immediately look into the matter and place a report before the court regarding disbursement of compensation to victims of the offence[4]. DLSA Secretary, if required, shall call for inspection of the school and interact with the children, it added. The bench further directed that the concerned authorities shall “ensure that every step is taken for welfare, security and safety of children”. The court’s direction came on a social worker Prashant Kumar’s PIL highlighting the absence of due care and framework during appointment of personnel and volunteers at the special home for visually-impaired minor inmates in south Delhi.

PIL sought a multi- disciplinary SIT probe into the affair: Advocate Ajay Verma, appearing for Mr Kumar, alleged that if there would have been a proper mechanism, the incident of sexual offence that has occurred recently at NAB, could have been prevented. 54-year-old Murray Dennis Ward was arrested and remanded to judicial custody in a case of alleged sexual assault on three visually-impaired minor inmates of the special home. The police has told the trial court that Ward had been associated with the NAB as a regular donor for almost nine years and was a frequent visitor to the institute. He was arrested for allegedly inappropriately touching three NAB inmates on September 2, police has said. Ward, a native of Gloucestershire in the United Kingdom, had been working with Sterlite Technology Limited in Gurugram till April. Seeking to prevent such incidents in future, the plea has sought court-monitored investigation by constituting a multi- disciplinary SIT to actively monitor the probe in this case. It said that there should be time bound investigation to ensure impartiality. The plea filed by advocate Katyayini also sought protection for witness in the case and said the court should issue direction to formulate regulation for volunteers and donors who visit the special schools.

How the pedophiles should be handled?: One out of every two children in India is sexually abused, most never report it, 52% of the cases are boys, implying 48% are girls. In other words, pedophiles have been raping teenage girls also. Rape of teenage girls up to 18 cannot be ignored by dubbing as “child abuse”. Psychologists dubbing such practices as “grooming” in Indian context try to cover all domestic, educational, social and religious interactions[5]. Present-day writers and columnists in trying to justify that such pedophile tendencies have been existing in Indian society, try to draw such parallels and vulgarize normal relationships to fit into some hypotheses and theories[6]. All such actions could not be brought under generalized psychological grouping behaviour.

If all such behaviour of parents are restricted to “Oedipus complex”, then, none is spared. Oedipus complex in psychoanalytic theory, is an assumed desire for sexual involvement with the parent of the opposite sex and a concomitant sense of rivalry with the parent of the same sex; a crucial stage in the normal developmental process. When Sigmund Freud introduced the concept in his Interpretation of Dreams (1899), it has become famous in western societies. If such hypotheses and theories haunt all sons and daughters, then, all parents would be sexploiters. Therefore, the psychologists and socilogists should come to reality to analyse as to why the foreign pedophiles mostly prowl upon Indian teens, why and orphanages supply victims knowingly, how the predators and perptrators work together and such other related issues should be taken into account. Now, in the western context, pedophilia is considered as “disease” as cold and fever, implying, pedophiles can rape gteenage girls and get away with that declaring that the rapists are patients with disease. Or after be ing caught, he can get admitted in hospital for treatment. Therefore, such interpretation should not be allowed in Indian context and the sex criminals should be properly booked, adjudicated and punished.

Since he is not fully recovered he will be confined to a cell in Thiruvananthapuram medical college hospital for some more days[1]. Chief minister Pinarayi Vijayan also lauded her, saying it was “a courageous step”, and the government would do everything to support her[2]. Legal experts said a case against the sexual abuse victim—she told the police that the godman Ganeshananda alias Srihari sexually exploited her since class 10—who resorted to action in self-defence, won’t stand much in a court of law. The state women’s commission has pledged all support to her. Commission member Prameela Devi said the young woman was forced to take such an extreme step. “The incident is a big warning to all sexual predators,” said Congress leader Bindhu Krishna. OK, but, why the earlier sexual predators have escaped raping “children”, scholls and college girls, actresses and so on! Why none of them cut penis of their sexual predators and rapists?

Why the girl was entertaining him for eight years?: Every female child, girl and woman has instinctive to feel and understand even the eye-blink, looking, grazing of man. Therefore, no man could override such inherent nature of woman to touch her. Even if touching exceeds the limits, she could understand, whether she is touched by his father, brother, relative or friend. Therefore, none could go on raping a girl for seven / eight years and the girl has been enough to get indulged in such act. Unless, there has been compulsion, coercision or obligation on any pretext, she would not have allowed any man to do that. Having accepted for seight years, why suddenly in 2017, she should decide to cut his penis! As a bold girl, daring dame and audacious amazon, she need not have waited to keep a knife like that and cut his penis on Friday 19^th May, 2017. Though, no aspersion is cast on her or her modesty or womanhood in general, this doubt has to be clarified. Similarly, Hari has to be answerable for his eith year sexploitation on any pretext. He could not have fooled the girl and others by donning ochre and indulged in such sexual activity. In spirituality, father-like status and protector of womanhood, no Hindu for that matter could have committed such act. If that is the case, then, as Surpanakai’s nose and ears are cut, his punishement is justifiable.

What happens if the Awami is dead?: The woman had attacked the godman around 11.30 pm on Friday (19-05-1017), when he forced oral sex at knife point at her house in Thiruvananthapuram Pettah. She snatched the knife and severed his penis and ran out of the house. She then called the police control room and said she feared he would kill her. Soon police shifted him to Thiruvananthapuram medical college hospital. Initially there were reports that she hid a knife below her pillow and attacked the godman, but police later corrected it. Admitted in serious condition, plastic surgeons and urology specialists did two surgeries on him to check blood loss and created a temporary urine tract. When he was admitted, hospital sources said, his penis was almost severed. So the doctors have decided to save him at any cost. To escape from the clutches of law, he initially told the police that he cut his penis himself as an act of penance but later admitted that the woman had attacked him. Suppose, if he dies, what happens? Those who discuss about legality have been silent about this.

Media warns that Hindu Swamis might be attacked in Kerala: The attack on Srihari has put self-styled godmen in the glare again, with police fearing more attacks on them. When Santhosh Madhavan alias Amritha Chaitanya, a self-styled saffron-clad godman was arrested in 2008 for assaulting many minor girls, several attacks were reported against godmen in the state. He was sentenced to life imprisonment in 2009. Santosh Madhavan (born 7 June 1960) is an Indian Godman under the name of Amritha Chaithanya. Santosh Madhavan has been wanted by Interpol since 2004 for fraud committed in United Arab Emirates. A Dubai-based Indian woman, Serafin Edwin, accused him of cheating her of 400,000 dirhams in 2002. He founded Shantitheeram trust under his and his parents’ name. He was arrested near Cochin on May 18, 2008 for fraud.  He was found guilty of pedophilia and producing pornography videos of him molesting underage girls. While in police custody, he complained of chest pain and was admitted to hospital. He was sentenced for 16 years in prison for molesting two underage girls on May 20, 2009. So why, the media has been reacting in this way? When the Christian and Mohammedan swamis, sanyasis, priests, kajis, mullahs, pastors etc., raped hundreds and thousands of girls, women etc, none of them was attacked, then, why the “Hindu Swamis” should be attacked? So, here also “secularism” plays effectivesly against Hindus.

Why Kerala CM, feminists and media have been politicizing the issue?: As Hari raped the 23-years girl / woman, he should be punished. As case has been booked and he has been hospitalized fighting for his penis cut with surgery, blood loss, treatment etc. After his cure, he would be prosecuted and jailed. But, before that, –

1. why the secular CM has been so happy in congratulating the girl who cut penis;
2. why media threatens / warns other Hindu Swamis dfor attack;
3. Why “The Hindu” should feel that the state BJP was in an awkward position, trying to defend himself against being seen as the godman’s ally;
4. Why total tirade against one particular identity with all these ganged together;
5. What is the background of this propagandist attack?

If all these want persons / groups want to politicize the issue, let them politicize, but, as per the secular principles, why they kept quite for other cases – this question would be asked by any common man, who observes the Kerala sex-affairs, rapes and other gender offences. Incidentally, Kerala claims that it has the highest literacy, then, all such educated would not take sides in this way. So the Indiand wait and see how many more penis are cut in Kerala?

In secular India all sexual crimes have to be handled and decided equally: In India, we have been watching as to how the Christian fathers have been carrying on their sexual agffairs with nuns, inmates and children of convent, destitude and orphanage homes. Similarly, Mohammedans have been also doing the same, though, only few cases are reported and many suppressed with vested interests. Under such circumstances, wit the background of growing sexual crimes in Kerala, the authorities should be unbiased, balanced and seculat enough to deal with similar issues. The opinion making and decision authorities cannot indulge in propaganda, adopt double standards and adapt bias in their official discharge of duties. As otherwise, wrong signals would be sent to the common people and in long run, they may loose confidence in them. Therefore, they should not force them to the corners to suffer continuously by ideology and other suffering and harassing factors.

“Raping is just like drining tea” – now it has been secularized in Kerala: Kerala, though often claimed as “the God’’s own country”, women are treated badly, as rapes are very common. Ironically, some three decades earlier, former Communisy CM, E. K. Nayanar declared that, “Raping is just like drinking tea”! Whether he told for his party’’s ideology or otherwise, when, the Communisty party again returned to power in Kerala, raping has become a daily affair. The police report gives details as follows[1]: A total of 16,960 cases of crime against women and children, including 2,568 rapes, have been reported in the last one year in Kerala. According to the state police’s provisional crime statistics, of the total rape cases, women were victims in 1,644 incidents while children in 924 reported cases across the state in 2016, compared to 1,263 and 720 in 2015 respectively. Of the total crimes against women and children, 14,061 were against women and 2,899 against children, it said. The number of cases registered under Protection of Children from Sexual Offenses Act (POCSO) during the period was 2,093, it said. Besides rape, other crimes against women, including molestation, kidnapping, dowry death and cruelty by husbands/relatives, also showed an upward trend last year , 2016[2]. After Abhaya rape-murder, Ice-cream parlour sex, actress rape, pedophiles, Catholic and Mohammedan sex etc., now a “Swami-sex” has been reported!

A Kerala godman was raping a girl for eight years: A 23-year-old woman gashed the genitals of a self-proclaimed the accused Sreehari alias Ganeshananda Theerthapada Swami, a 54-year-old ‘swami’, godman when he tried to sexually assault her on Friday (19-05-1017). Initially, police planned to charge the woman, a final year law student, under sections of self-defence, but dropped the idea when women’s bodies raised their voice, saying this will put more pressure on the victim[3]. The TV channels started debate already mostly praising the girl[4]. Thus, Kerala police decided to drop charges against the, as support poured in from various quarters for the victim[5]. The victims’ parents were followers of the Swami who belongs to an ashram in Padmana in Kollam, Kerala. A case has been filed registered against the swami under IPC section 376 (rape) and under sections of Protection of Children from Sexual Offences Act (POCSO)[6]. “Case had been filed under POCSO as the assault and rape seem to have started when she was a minor,” police were quoted as saying. Strangely, the girl’s act is eerily similar to a Malayalam movie sequence called ‘”22 Female Kottayam”, where the heroine apparently castrates the hero for betraying her. Legal experts started discussing as to whether the girl also could be punished under law or not, as she has committed a crime, but, to protect her modesty[7]. However, why she did not go to police earlier, but, had chosen only now, after punishing him[8].

Tea shop owner turned Swami to rape the girl: The “Tea-syndrome” has been affecting the psyche of Kerala, as, here also, the alleged rapist was a te-shop owner! The police said the accused used to run a tea shop near Ernakulam before he took up spirituality. He came into contact with the family a few years ago, promising to cure the girl’s bedridden father and he ​used to visit the woman’s house to conduct pujas for him[9]. “Whenever he visited Thiruvananthapuram, he used to stay with the family. He has also travelled with the family to relatives’ houses in Kottayam and Ernakulam. He started abusing the girl sexually from the time she was in Class 10. She did not resist it for many years. It was when she started studying law that she started resisting his advances, which led him to use coercive methods against her,” the police said. According to the woman, her mother was well aware of the Swami’s acts and he had repeatedly assaulted her at home[10]. That means how this was allowed, accepted and tolerated is not known. Aware of his arrival on Friday night, the victim is said to have kept a knife ready to chop off his genitals, thus, the reports went on!.

“The Hindu” has been so happy to provide “Swami’’s” connection with “Hinduism”: “The Hindu” has been evidently proactive in giving “Hindu-side” of the Swami. It reported[11], “The accused has been associated with the Hindu Aikya Vedi, being part of a team of spiritual and political leaders who submitted a memorandum to the then Chief Minister in 2010, demanding the withdrawal of a government order to take over the administration of ashrams, maths, and temples in northern Kerala”. The Panmana Ashram has distanced itself from the accused, saying he was no longer part of it[12].  Meanwhile, the Panmana Ashram, which was founded by social reformer Chattambi Swamikal, said in a statement[13], “The Swamy had left the ashram 15 years ago after completing his studies.” Thus, why “The Hindu” has been so active in giving details about the Swami. In Kerala, there have been so many sexual exploitation by the Christian and Mohammedan clerics, Bishops, pastors and so on, but, it never carried on to give details of them. Many times, it has chosen to mention the accused / alleged person’s name to know his religion!

“The Hindu” continued – BJP State president was in an awkward position, trying to defend himself: BJP State president Kummanam Rajasekharan was in an awkward position, trying to defend himself against being seen as the godman’s ally, as one photo appeared in which he was with the alleged “rape-swami”. Briefing the media, Mr. Rajasekharan said while he had known the sanyasi, the latter had no connection with the BJP or the NDA. “He used to attend the meetings of sanyasis . He was part of the group that accompanied me to visit V.S. Achuthanandan when he was Chief Minister. There should be a thorough investigation into the incident and strong action should be taken against the guilty. The police should bring out all facts pertaining to this,” he said. On the godman’s participation in several agitations, including the Aranmula protest, Mr. Rajasekharan said: “Many sanyasis took part in it.” So, what “The Hindu” has achieved has to be analyzed. The social media would be gleefully spend time with these details attacking Hindus, Hindu belief-system, rituals and other issues. As the media had been dead against “Nityananda”, such propaganda might be unleased.

June 2016 flooded with pedopphile cases adjudicated in London, but connected with India: In June 2016, pedophile cases are adjudicated and decided in London courts prosecuting various categories, as reports appearing in the media. They are first Richard Huckle, second Vijesh Kooriyil[1] and then, columnist Hasan Suroor. Indians really have to wonder as to how all these pedophiles have been connected with India, particularly South India. Indians do not know as to such pedophile cases would be decided in June one by one.  Richard Huckle was visiting Bangalore Christian orphanage,   Vijesh Kooriyil hailing from Malappuram and Hasan Suroor, the famous columnist of “The Hindu”! As Indians are imbibed with secularism, western and leftist ldeologists, they are made to think as this prosecution has been of the British type or secular type. Richard Huckle has been Christian, Vijesh Kooriyil obviously Hindu and Hasan Suroor Muslim! Whether the court cases are timed, reporting coincidental or assumed pattern incidental would be decided in due course. However, the accelerated interest, swift attention and rapid curiosity exibited by certain Indian media makes Indians to concentrate in the news. Yes, the Hasan Suroor has been picked up by “The Hindu”, “Outlook, “Scroll.in” etc., to come out with response evidently heaving a sigh of relief. First look at the news appearing in the media.

Charged Hasan Suroor found not guilty: A UK court on Tuesday (07-06-2016) dropped a case of “sexual grooming” against an Indian-origin British journalist, London-based Indian journalist and columnist Hasan Suroor for lack of evidence and declared him not guilty[2]. Suroor was ‘trapped’ by a vigilante group at a spot in south London and subjected to aggressive and threatening questioning by the group. The Crown charged Mr. Suroor with violating Section 16 of the Sexual Offences Act 2003 (sexual grooming of a child) and Section 1(1) of the Criminal Attempts Act (1981)[3]. The Crown formally withdrew charges as its chief witness Jonathan Clark, a member of the vigilante group, withdrew his support for the prosecution and failed to appear. Further, Mr. Suroor has no digital footprint of grooming, which is common marker of online sexual grooming, his lawyer Paul Mason told The Hindu[4].

Serious allegations were sought to be pursued on the basis of a “telephone call” from an “unregulated” vigilante group: Suroor, who was arrested by British Transport Police (BTP) last November 2015 after an anti-paedophile sting operation in London, is now planning to sue the vigilante group, Unknown TV, behind the sting for damages[5]. “Following a further review of the case there is now no longer a realistic prospect of conviction,” the UK’s Crown Prosecution Service (CPS) told Blackfriars Crown Court in a written submission on Tuesday (07-06-2016). The judge ruled that he had decided to return an “unequivocal verdict of not guilty”. He said he was “extremely concerned” that such serious allegations were sought to be pursued on the basis of a “telephone call” from an “unregulated” vigilante group[7]. A member of the anti-paedophile vigilante group had allegedly posed as a 14-year-old and allegedly solicited Suroor on social media[10]. Groups such as Unknown TV pose as minors on dating and social networking sites in an attempt to catch adult men who solicit sex with minors[11].

She has been so faithful and loyal to mention him as “Mr.Suroor was ‘trapped’”……….. subjected to aggressive and threatening questioning by the group. …….. as its chief witness Jonathan Clark, a member of the vigilante group, withdrew his support for the prosecution and failed to appear……… Further, Mr. Suroor has no digital footprint of grooming, which is common marker of online sexual grooming, his lawyer Paul Mason told The Hindu……..”. Paravthi Menon as been a vigorous writer on Ayodhya related issues[16] commenting upon the Supreme Court judgment and so on, particularly criticizing Hindutwa[17].

“….chief witness Jonathan Clark, a member of the vigilante group, withdrew his support for the prosecution and failed to appear….”: The proceedings, as reported by the British media has been intriguing, for the following reasons:

1.       The CPS is yet to officially comment on the case.

2.      The written order to be out on June.24, 2016.

3.      The complaintant / witness did not co-operate or became hostile.

4.      That is, the chief witness Jonathan Clark, a member of the vigilante group, withdrew his support for the prosecution and failed to appear…

5.      The Vigilant group may appeal.

Why then, the particular Indian media houses react differently for Hasan Surror, but keeping silence on the first two pedophiles ant the related issues. When India has already been affected by the pedophile menace, how they could react with bias towards Hasan Suroor alone without caring for thousands and perhaps, lakh of Indian children, young boys and girls, teenage girls and others. Really, it is ironical that they play “communal card” under the guise of “secularism”!

“Barbaric crimes should definitely attract barbaric models of punishment”[1]: In a strongly-worded order, the Madras High Court had earlier this month recommended castration as punishment to child sex abusers observing that “barbaric crimes should definitely attract barbaric models of punishment”[2]. Justice N Kirubakaran, in a recent order against a British national, made the recommendation to the Centre saying that castration would achieve “magical results” in preventing child abuse. “When law is ineffective and incapable of addressing the menace, this court cannot keep its hands folded and remain a silent spectator, unmoved and oblivious of the recent happenings of horrible blood-curdling gang rapes of children in various parts of India,” he said[3] castration for child rapists would fetch “magical” results in preventing child abuse. The judge said this while dismissing a petition by the accused, a British national, who sought the quashing of the proceedings against him in a lower court. The judge further said that “though the suggestion of castration looks barbaric, barbaric crimes should definitely attract barbaric models of punishment” and the very thought of the punishment should deter the culprit from committing the offence. Anticipating a reaction to his judgment, he said: “Those activists should first exhibit sympathy with, and support to, the victims of such crimes by visiting and consoling them at the hour of crisis instead of having misplaced sympathy with the perpetrators under the usual banner of ‘human rights violation’. They must remember that ‘human rights’ is not a term restricted to, and reserved only, for offenders.” He also directed the Union government to decide on introducing compulsory sex education for high school students. “Denying youngsters correct and scientific information would lead [them] to acquire half-baked and incorrect knowledge from other sources, like Internet, friends and movies, creating misconception and doubts.”

The accused paedophile has been from Britain[4]: Taking note of the number of cases of foreigners abusing children, the judge referred to the International Child Protection Certificate (ICPC) developed by the United Kingdom to protect children and said the visa form issued by the Indian Embassy had to be amended with the provision of a column requiring the applicants to give the details of convictions, actions warranting reprimands and impending cases. According to the prosecution in the present case, the British national, had sexually abused a 15-year old student in 2011, after befriending the family by promising the mother that he would support her son’s education. The accused eventually took the Class 9 boy to Delhi, where he allegedly abused the victim, including attempts to have sexual intercourse. After the Briton left for London, with the help of the Justice and Care Organisation, the victim filed a complaint on the incident, following which a case was registered under relevant sections of the IPC and Juvenile Justice Protection Act. After the Judicial Magistrate took cognisance of the case in 2012, following the filing of the final report, the accused moved the court seeking to quash the proceedings against him. Following the issuance of the non-bailable warrant against him, a red alert was issued against the accused by the Interpol. The accused contended that the notice was preventing him from coming to India to defend the case. The judge has dismissed his plea to quash the proceedings against him but stayed the red corner notice so that he can come to India to appear before the trial court and face the case.

The opinion of Abha Singh, social activist[5]: Welcoming the Madras High Court’s suggestion of considering castration as punishment for child rapists, two social activists on 26-10-2015, Monday said that the suggestion made to the Centre was apt as the existing Indian law is unable to protect the child from abuses. “Child abuse cases in India are increasing. The Madras High Court in one such case has come up strongly and said that the Indian law is unable to prevent child abuses. The conviction rate in child abuse cases is barely 2.4 per cent whereas the offences against children have increased by 400 per cent,” social activist Abha Singh told ANI. “When rapists are going scot-free and paedophiles are going scot-free, a Madras High Court judge has rightly suggested that there should be castration. Many other countries like UK, USA, Polland and many other countries subscribe to castration and it has been seen that it has been successful in checking the paedophiles,” she added.

What Pramila Nesargi opined[6]: Another social activist and lawyer Pramila Nesargi echoing similar sentiments expressed her delight with the Madras High Court judge’s suggestion. “I always advocated that castration can be the only remedy because the existing law is not creating any fear in the minds of the people. People may call it barbaric but judge has openly said that barbaric punishment should be given for barbaric crimes,” Nesargi told ANI. However, when such cases were reported earlier, the activists were not responding. In Indian society, the social aberrations have been introduced or created due to external factors, distorting the existing social system and institutions. The offenders have been escaping under the newly created laws with the crimes committed before the enactment.  The sociologists, psychologists and other researchers opine based on these incidences, which are happening in a country with 1.2 billion population. As so many external and internal factors have been disturbing, the people also get affected. Allowing modern evils at one side, supporting them under the guise of  human rights and so on and crying wolf about eroding moral values have been the characteristics of  the commentators on Indian society.

Dilemma of Indian society caught in many social issues: In India, most of the child-rapists or paedophiles have been foreigners. The number of child abuse cases has increased from 38,172 in 2012 to 58,224 in 2013 and to 89,423 in 2014. Incidentally in 2013, at the height of the protests in the capital over the Nirbhaya case, Tamil Nadu chief minister J Jayalalithaa had similarly called for death or chemical castration for rapists through amendments in Central laws[7]. As Bangalore has been prone to foreigners satisfying their needs, issues have been alive in the case of pubs, pub-dancing, soliciting and other activities, which might be viewed and interpreted differently. Of the 51 cases of child abuse under the Protection of Children from Sexual Offences Act in the special court for children in Bengaluru, only four have ended in convictions. More than 90% charged under the Pocso Act are acquitted due to lack of evidence and when witnesses turn hostile[8]. Not that evidences were not there, but, the manipulators could influence the involved processes. As example, it is mentioned that children migrating from Tamil Nadu and northern India to the city are the main victims of child abuse whose cases are tried in the session court. Most of these children live with their mothers and fall prey to step-fathers and other offendes. Most abusers are between 25 years and 50 years. The youngest victim so far is just a year old. But, this could be the situation for all Indian children. The highest number of FIRs has been registered in Rajasthan followed by Maharashtra, Uttar Pradesh, Madhya Pradesh and Kerala according to data available with the National Commission for Protection of Child Rights (NCPCR). The number of convictions is only 166 that is 2.4% of the total cases registered while in 389 cases accused were acquitted[9].

Madras / Chennai has been haven for paedophiles: For inexplicable reasons or otherwise, Chennai has seen many international paedophiles got arrested. The locals have also been aiding and abetting such offenders and promoting social crimes. The manipulation of cyber-space has been revealed in many acts. Child rights activists in Chennai have forced authorities to shut down two Facebook pages in Tamil created to attract pedophiles in May 2015. The pages, called ‘chinna ponnu karpazhipom‘ and ‘chinna ponnu veriyargal’ which in Tamil roughly translates to ‘young girl having sex’, had photographs of young girls with a number of sexually explicit comments.

They were spotted by social activists who immediately contacted the authorities to take it down, CNN-IBN reports[10]. 53-year-old Eric Martin alias Jack Fernandes , convicted for raping nine girls in 1998,  had gained entry into India through Nepal and was staying in Madhavaram in Chennai. He had been on the run ever since he was convicted in France and was on Interpol’s Wanted list[11], but arrested in Chennai on November 17, 2010.

Patrick Matthews, a 62-year-old UK national who was accused of sexually abusing several boys of St George Anglo-Indian Higher Secondary School in the city between 2003 and 2006, has been arrested by the UK police in August 2009. Sources told TOI that the police arrested Matthews from the UK on Thursday night based on evidences collected from Chennai[12]. Wilhelmus Weijdeveld, the 56-year-old Dutch national now in prison facing charges of child sexual abuse and supplying child pornography, had found that India suited him best’ and even filed for citizenship as early as in 1999, thwarting the attempts of the police to drive him away from the country. He even filed a writ petition against the state of Tamil Nadu, after the Mamallapuram police asked him to leave the country. It was only after three years, on May 02, 2002, that he was arrested for sexually abusing five boys in an orphanage near Mamallapuram. Out on bail, Wilhelmus was arrested again from his Choolaimedu den in Chennai on November 7, 2009 following an Interpol tip-off that he was uploading child pornography on the internet[13].  These are given only for illustrative purpose, as many cases have been reported regularly, and most of them been from the orphanages run by the missionaries in and around Chennai. Therefore, the Judge must have been aware of such incidences. Stringent legislation was the need of the hour to penalise child sexual abuse via the Internet, said Chief Justice of India, Justice P. Sathasivam[14], while inaugurating  two day Southern regional conference on Protection of Children from Sexual Offences (POSCO Act, 2012)’, in Chennai, in November 2013.  Therefore, castration as punishment to them, as proposed has been the logical conclusion.

Arrested-Police in southern India have arrested Rev. Joseph Palanivel Jeyapaul, who is wanted in the U.S. on sexual assault charges

Swami Nityananda is now known to many in India, because of the media that spread the video and connected details off and on many times in India. However, Joseph Palanivel Jeyapaul, who has also been involved in a similar case, but more serious, has been played downed by the media in a casual way. Though only news has come out about Joseph Palanivel Jeyapaul, nothing is known to Indians.  Under the guise of attending his sick mother, he came to India, but did not return to US, so US asked for deportation. Ironically, now, he is deported to India, after neutralizing his prison term, though convicted for the sexual charges[1]. The defrocked priest admitted to sexually abusing a teenage girl and then fleeing the country to avoid prosecution, but he would not serve any jail sentence, as he settled a $750,000 civil suit with his sex-victim as a part of a plea deal with prosecutors[2]. In Tamil, there is a comedy strip shown frequently in vernacular TV channel about one ‘Minor Kunju’ who was involved in raping women, but used to pay the mandatory fine of Rs. 5,000/- in advance, so that he could go for raping another. So, the comedian reportedly shot his ‘kunju’ meaning penis!

Accused Priest and tight-lipped Catholic authority (June 2015): Joseph Palanivel Jeyapaul accepted guilty on June 19^th 2015 to fourth-degree criminal sexual conduct, a felony, in one of the two cases. The other case, in which he is charged with two counts of first-degree criminal sexual conduct, was pending[3] in the case of molesting a girl in US in 2005. He faces up to 15 years in prison at his sentencing scheduled for June 15, 2015. The case was dragged on for more than 10 years, because of the Catholic Church in India was obviously aiding and abetting with him. Even now, the Catholic Diocese to which priest Joseph Palanivel Jeyapaul, accused of sexually abusing a minor girl in the US, is attached, is tight-lipped about the developments[4]. “We are yet to receive any such information. We can comment on this only after we get proper information,” maintained Diocese PRO Selvanathan, speaking to “Indian Express” over phone and also refused to comment on the stand of the diocese on the charges[5]. Really, when this has become an international story and the Madras Bishop was responding to the Roseau County Courthouse authorities and the Vatican defrocked him, Selvanathan decided to play safe.

Frivolous petition, dragging case in Madras (2013): In 2013, when Jeyapaul was arrested and jailed in Tihar, her sister filed an petition in the Madras High court. The Court on June 28. 2013 (Thursday) dismissed a habeas corpus petition seeking the release of a parish priest, who had allegedly sexually-abused a 14-year-old girl in the US, and who was now lodged in Tihar Jail in New Delhi[6]. A Division Bench comprising Justices V. Dhanapalan and C.T. Selvam passed the order on a petition by one P. Pushpavathy, challenging an order of the Ministry of External Affairs, of March 8, 2011, requesting the Additional Chief Metropolitan Magistrate, Patiala House Courts, New Delhi, to inquire into the request for extradition of the petitioner’s brother, Joseph Palanivel Jeyapaul, to the US. To facilitate the inquiry, an arrest warrant against Jeyapaul, who was wanted by the US authorities for alleged “criminal sexual conduct in the first degree”, under that country’s laws, was necessitated. The warrant was necessary as he was not available for the inquiry. The petitioner said Jeyapaul was incardinated to the Catholic Diocese of Ootacamund and was ordained a priest in May 1982. He served as Assistant Parish Priest in St. John De Britto Church, Sathyamangalam, Erode district, from 1982 to 1983 and became a parish priest in 1985.

On an invitation to serve at the Blessed Sacrament Catholic Church in Greenbush, Roseau Country for three years, he left for USA in August 2004 but returned to India in August 2005, as his mother was critically ill. Under these circumstances, the MEA issued the impugned order. Following that, an application was filed before the Additional Chief Metropolitan Magistrate, for arresting Jeyapaul. The Interpol issued an alert after it was found that he was in India[7]. He was arrested on March 16, 2012 at Chimitahalli in Erode district and remanded to custody and lodged in Tihar Jail[8].

Hence, the present petition. Mr. Justice Dhanapalan said while the parish priest was in the US, he was alleged to have sexually-abused a 14-year-old girl. The fugitive accused had been arrested pursuant to a warrant issued by the magistrate. A reading of the MEA’s order made it clear that it was the Centre which made the request to the Additional CMM to inquire into the matter. The course adopted by the Ministry could not be termed ‘detention’, much less ‘illegal detention’. This was a matter which concerned countries under the treaty which provided for certain obligations on the extraditing country to look into, under the relevant provisions of the law. The procedure had been followed and the MEA’s order was in accordance with law, the Judge said.

The callous attitude of CBCI (2011-12): Father Babu Joseph of the CBCI said, “He (Jeyapaul) will certainly cooperate with the civil authorities (in US) inquiring into the matter in case there is further need for him to go to the US……We are taking the allegations against him (Jeyapaul) seriously…..already some administrative actions have been taken against him….He has not been assigned any parish or any pastor work. On the contrary he has been asked to stay in the Bishop’s house and help out in his office work… He has been kept away from children and people,” he added. Jeyapaul had fled to southern India in September 2005 after he was accused of molesting the girl. Wanted in the US on sexual assault charges, he was arrested by Indian Police in March 2012.

Madras Catholic Church helping Joseph Palanivel Jeyapaul (2010): Joseph Palanivel Jeyapaul, facing charges of sexually assaulting a 14-year-old girl in Minnesota, United Sates, was on Tuesday (April.5 2010) asked by the Archbishop of Madras to return to the U.S. for further investigations. As the Diocese of Udhagamandalam, the home Diocese of Jeypaul, which oversees the priest of Indian origin, said it was probing the matter in detail. The Archbishop of Madras M. Chinnappa said he had spoken to the Bishop of Ootacamund on Tuesday to take action against the priest. Fr. Jeyapaul was currently staying in the hill town in Tamil Nadu. “I have asked the Bishop of Ooty to comply with the demands of the case. Jeyapaul must return to the U.S. if necessary for further investigations. He has to oblige. There is no way out,” Fr. Chinnappa said in Chennai. Prosecutors in Minnesota yesterday said they were trying to extradite 55-year-old Jeyapaul. Fr. Jeyapaul, however, had denied the sexual abuse allegations and reported to have said he has no plans to return to the U.S. to face the courts there[9]. Vatican officials recommended Jeyapaul’s removal from the priesthood, but the local Indian bishop instead sentenced him to a year in a monastery through a canonical trial[10].

USA requested extradition and India extradited (2007): In January 2007, a case was filed against him in the Roseau County Courthouse, Minnesota. Four years later, the US officials sent an extradition note to the Ministry of External Affairs, Indian government, which in turn asked the Additional Chief Metropolitan Magistrate of Patiala House Courts, Delhi, to inquire the request and decide on its ‘extraditability’ based on the nature of offences. Based on a warrant issued by the Additional CMM, Jeyapaul was arrested from Erode district on March 16, 2012. His bail pleas and the habeas corpus petition filed by his sister Pushpavathy in the Madras High Court alleging ‘illegal detention’ were rejected, and Joseph Palanivel Jeyapaul was extradited by the Indian Government to the US[11].

Wanted fugitive Bishop in Ooty enjoying life (2004-05): In a statement handed over to reporters, who had gone to meet Fr. Jeyapaul in Udhagamandalam, Bishop Fr. Amulraj of the Diocese said the matter had already been referred to the Catholic Bishops Conference of India (CBCI), the highest Catholic Organization in India for necessary direction. Fr. Amulraj earlier said Fr. Jeyapaul had gone to meet his advocate to Chennai regarding the cases, which came to limelight through the press. In the statement, Fr. Amulraj stated that it was true that the said priest was working in the Diocese of Crookstone in the State of Minnesota in the U.S. from September 2004 to August 2005. “Suddenly he had to rush back to India to see his ailing mother and he never returned to U.S. since then…………In the meantime some sexual abuse cases connected to Fr.
