Idol-theft case, where the Idol-wing Police themselves involved- the accused DSP absconding and the current IGP transferred!

In 1980, there was sudden increase in theft of Panchaliga idols – Idol Wing Police – History[1]: Idol theft cases were investigated by a small team of officials in CB-CID till the year 1980. During the year 1980 there was a sudden increase in thefts of Panchaloga idols. The thefts of such idols from the temples affected the sentiments of the local people. A proposal was initiated by the Director-General of Police to re-organize the strength allotted for investigating the idol theft cases. The Government accepted the proposal, constituted Idol Wing CID Vide G.O.Ms.No.2098 Home (Police IV) Dept Dt. 7.10.1983, with 1 SP, 1 DSP, 5 Inspectors, 3 SIs, 4 HCs, 3 Gr.I PCs and 13 Gr.II PCs. The unit functions from the Head Quarters, Chennai.  In the year 2000, CB-CID was bifurcated and Idol Wing was brought under the control of Economic Offences Wing in accordance with the order issued in the Chief Office Proceedings Rc.No.RAI (2)/273552/98 dt.30.12.1999. At present Idol Wing CID is headed by DIG-Idol Wing and assisted by one DSP and 5 Inspectors of Police.

Primary functions of the Idol Wing CID

  • To investigate cases of theft of idols and antiques exceeding value of Rs.5 Lakhs.
  • To investigate idol theft cases referred to it by the State Government.
  • To co-ordinate in the investigation of important idol theft cases handled by the District Police
  • Collection of intelligence on nefarious activities of antique dealers and art collectors.

 However, the idol teft in Tamilnadu has been going on obviously with the connivance of the persons involved at temple, idol-wing police, atheist politicians and others.

2008 case dragged up to 2017[2]:  In May 2008, idols recovered by Arociaraj was attempted to be sold to somebody through his accomplicw Subburaj. At that time Khader Batcha intervened and brought them to Chennai. Later he sold to some agent. According to Rajendran, he found a cover kept under his car wiper on April 12 last, which stated that one Arockiaraj of Aladipatty in Aruppukottai taluk found two panchaloha idols — Sivagamy Amman and Siva Parvathy -on a pedestal. Instead of handing them over to the police, they tried to sell the same to a foreigner in collusion with one Santhanam of the same village. However, two cops caught them red-handed and handed them over to police inspector Kader Batcha. The accused sub inspector Subburaj, 54, currently serving in Koyambedu police station, was serving as a head constable in 2008 in the Idol Wing when he, along with inspector Kader Batcha, is said to have obtained the antique idols from the farmer and sold them to another smuggler Deenadayalan, who is currently facing many idol smuggling cases, for Rs.15 lakh.

In January 2017, a case was registered against Kader Batcha, Subburaj and a few others[3]: The incident surfaced only in January 2017, when the idol wing registered a case against Kader Batcha, Subburaj and a few others. The case did not see much progress and in the course of years Kader Batcha was promoted as Deputy Superintendent of Police and is now serving in Tiruvallur district. Subburaj was promoted as a sub inspector of police and was serving in Koyambedu police station. While Subburaj was arrested on Monday 26-06-2017, the Idol Wing officers said Kader Batcha was absconding. A case has been filed under IPC provisions for alleged offences including robbery, or dacoity with attempt to cause death or grievous hurt, said Inspector-General of Police A G Ponn Manickavel. On Tuesday 27-06-2017, the petitioner informed the court that the case is now handled by an Inspector, who cannot effectively handle the same as the accused Kader Batcha is a DSP. Contending that it was a case of fence grazing the crop, the petitioner prayed the court to transfer the case to CBCID. A police sub inspector, one of the accused in an idol smuggling case, was arrested by Idol wing of the Economic Offences Wing on 26-06-2017 Monday. The arrest was made a day before the Madras High Court heard a petition seeking transfer of the case from the Idol Wing to CBCID. Justice R Mahadevan, before whom the petition from advocate ‘elephant’ G Rajendran came up for hearing on 27-06-2017, Tuesday, orally directed the Inspector-General of Police, Idol Wing Pon Manickavel to appear before him with all records of the case, on June 29.

: A day after the Madras High Court questioned the top brass of the state idol wing police as to why police personnel of their own wing involved in illegal sale of ancient panchaloha idols for several crores of rupees have not yet been arrested, the state government told the court that it had placed deputy superintendent of police Khader Batcha under suspension[4]. The judge orally asked the APP, “Why you have not arrested them. Don’t you know their whereabouts?”  The APP, Emilias said it will take some time to know their whereabouts[5]. The judge also asked Pon Manickavel what was the strength of the Idol Wing department. After Pon Manickavel explained the details, the judge asked him to file an affidavit as to what was the requirement and how many staff he requires. The judge posted to June 30, further hearing of the case. The judge also adjourned to July 21, 2017, the hearing on another petition filed by Rajendran, which sought a direction to the authorities to provide police protection to him and to his family[6]. In his petition, Rajendran alleged that he received information on Thursday that a high ranking police officer made a comment on him stating that “He always gives trouble to the government by filing petitions, harassed real estate persons, now he filed a petition against police. I will teach a lesson to him”. He sought to transfer the investigation of idol theft case to CB-CID.

The police assured that effective steps were being taken to arrest him (absconding DSP): When Justice R Mahadevan took up the matter for hearing on Friday [30-06-2017], special government pleader M. Maharaja and additional public prosecutor C. Emilias submitted that the DSP, Khader Batcha, suspected to have been involved in the idol theft and sale case, was placed under suspension with effect from June 29, 2017[7]. A sub-inspector, who was an associate of Batcha, has already been arrested. Though Batcha is absconding, there were rumours on Friday [30-06-2017] that he had been arrested near Andhra Pradesh border. The two law officers also furnished a copy of the suspension order before the court. They told Justice Mahadevan that effective steps were being taken to arrest him and that police would proceed with further investigation including recovery of idols in the case. The HR & CE department will cooperate with the police in the investigation, they said. As for Justice Mahadevan’s queries with regard to the staff strength at the idol wing police and vacancies dogging it, the law officers produced a circular issued by the DGP, allotting 20 police personnel, including a deputy superintendent of police, an inspector and a sub-inspector to the idol wing[8]. The judge then reserved his orders on the PIL, filed by advocate and activist Elephant G Rajendran[9].

Absconding DSP suspected to be hiding in Kerala[10]: CB-CID Idol Wing officers have intensified their search to nab Deputy Superintendent of Police Kadher Batcha, who has been suspended on for his alleged involvement in the illegal export of antique idols in 2008[11]. The news reports say that he was in Kerala or Andhra border hiding in a Ayurvedic clinic or resort. A.G. Ponn Manickavel, Inspector General of Police, Idol Wing CID, appeared before the Madras High Court and explained the details of the case to Justice R. Mahadevan who heard the plea moved by an advocate seeking transfer of the probe into a multi-crore idol theft case registered against two officials of the Idol Wing to the CB-CID[12]. Recording the appearance of IG, Justice Mahadevan orally instructed the prosecutor’s office to get instructions from the jurisdictional Superintendent of Police, Tiruvallur, as to why the police official involved in the crime was not yet arrested and file a report.

Case background as reported in “The Hindu”[13]: Manickavel told The Hindu, “We have zeroed in on the probable whereabouts of Batcha and teams have been sent to Kerala following inputs that he might be hiding there.” In 2008, Sundaramoorthy, a professional photographer, who was running a studio in South Mada Street in Madurai and was involved in selling antique idols, had displayed photos of antique idols. Batcha, who was an Inspector at the time, and Subburaj, then a head constable in the Idol Wing, quizzed Sundaramoorthy about the photos displayed. Following information given by him, the officers apprehended Arokiaraj, a resident of Aladipatti of Aruppukottai Taluk in Virudhunagar, who was trying sell some idols recovered from his agricultural land to a foreign national. Police sources said Arokiaraj and Sundaramoorthy were interrogated at a guest house in Virudhunagar but they escaped from there. The idols were in the custody of Mr. Batcha who, along with Mr. Subburaj, tried to sell them to Deenadayalan, an international antique dealer, for Rs. 50 lakh. As Deenadayalan was reluctant to buy the idols, they reportedly forced him to buy the idols for Rs. 25 lakh. The idols found their way to Manhattan gallery owner Subhash Kapoor, who is in Puzhal Prison.

GST - Ideal, but what is implemented

The Government may have to be soft with the dealers, as they are bound to commit mistakes and violate provisions of GST Act and Rules[1]: In the implementation of GST covering crores of dealers of various transactions, many assumptions and presumptions have been made, as if, all would be sitting at computers and handling with their commercial dealings only on-line always. The Government has not perhaps, realized the digital gap existing between the big and small taxpayers under the GST regime.

  1. The powerful federal indirect tax body, the Goods and Services Tax (GST) Council, would instruct field officers at the central and state levels to be lenient with traders for procedural lapses in the first year of implementation of the new indirect tax regime from 1 July, 2017[2].
  2. There is a confusion about the jurisdiction of the dealers and as well as the law-implementing officers. This confusion prevails between the Central and the State and also amomh themselves internally.
  3. In the first year they have to handhold them rather than penalize them for procedural infractions. Everyone in the council is sensitive about it. Major offences such as clearing of goods without invoices, however, is a different matter.
  4. The decision comes in the wake of apprehensions of the trade and business community about an anti-profiteering provision in the GST law intended to be a deterrent against not passing on the benefits of any reduced indirect tax liability to the ultimate consumer.
  5. The Confederation of All India Traders, a traders’ body with 60 million members, said in a representation to PM on 8 June, 2017 that a period of nine months beginning 1 July should be declared a transition period [up to 31-03-2018] during which traders will be given immunity from prosecution for procedural lapses.
  6. While businesses and large traders will be prepared for the GST roll-out with their IT systems, small traders, especially those in villages and remote areas, may take time to become part of the GST network on account of lack of awareness and infrastructure constraints.
  7. As everyone imagines, the internet connection and related issues are going to create many practical probles, coupled with frequent power cuts at rural and village areas.
  8. Another official in the government, who also spoke on condition of anonymity, said that the last point of sale—trader to consumer—in villages has always been the weakest link in the state-level value-added tax system.
  9. Important issues – addressing concerns relating to tax rates brought up by the industry and finalizing how the anti-profiteering mechanism, “advance ruling” and search and arrests, etc. Advance ruling is a facility available for taxpayers to get an idea of what the tax liability on certain transactions will be in advance.

SSI has to file 37 returns instead of 13; if they have units in more than one state, the returns increase accordingly[3]: A small­scale manufacturing company with operations in only one state will have to file a minimum of 37 returns instead of the current 13 once the goods and services tax (GST) goes live from July 1, 2017 increasing work for industry, accountants and banks, according to an IndiaSpend analysis. With the deadline for the GST less than a month away, finance professionals, banks and industry seem unprepared for the challenges of implementing the one nation­one tax idea, work towards which began 13 years ago. “The entire ecosystem needs to be changed to accept GST,” K. Raghu, former president, Institute of Chartered Accountants of India, told IndiaSpend. “An ideal date for implementation would be September 1.” The Indian Banks Association has informed a parliamentary panel that their members were unprepared to implement the new indirect tax regime. “Everything will now be online and will need to be updated regularly. A business will have to file 37 returns in a year (three returns per month and one annual return) per state,” the Economic Times reported on June 5, 2017.

GSTN - portal in demand

Business in three states means, he has to file 3 x 37 = 111 returns per annum[4]: “If it does business from offices in more than one state, the number of returns will go up accordingly. A business with offices in three states will have to file 111 tax returns in a year.” With the government announcing GST for four tax rates ­­ 5, 12, 18 and 28 per cent ­­ industry will face implementation challenges that include system upgrades, manpower training and understanding new taxes. Every transaction ­­ sale or purchase ­­ will now have to be recorded online to benefit from the tax paid earlier India is implementing a dual GST with the Centre and states together levying it on a common tax base. “The GST to be levied by the centre on intra­state supply of goods and/or services would be called the Central GST (CGST) and that to be levied by the states would be called the State GST (SGST),” according to the FAQs published by the Central Board of Excise and Customs (CBEC), the central body of indirect taxes. “Similarly, Integrated GST (IGST) will be levied and administered by centre on every inter­state supply of goods and services.” A dual GST adheres to the constitutional requirement of fiscal federalism, since both the Centre and states have the powers to levy and collect taxes. “The central GST and the state GST would be levied simultaneously on every transaction of supply of goods and services except the exempted goods and services, goods which are outside the purview of GST and the transactions which are below the prescribed threshold limits,” the CBEC FAQ noted.

GST opposed or supported

Meghalaya, Punjab, Tamil Nadu, Kerala, Karnataka, Jammu and Kashmir and West Bengal – have not passed GST[5]: While 24 states have passed state GST acts, seven have not ­ as yet. They are: Meghalaya, Punjab, Tamil Nadu, Kerala, Karnataka, Jammu and Kashmir and West Bengal. While the location of the supplier and the customer within the country is immaterial for the purpose of CGST, SGST would be charged only when the supplier and the customer are within the state. An illustration from the FAQ published by the government: Suppose the CGST rate is 10 per cent and the SGST is 10 per cent. When a wholesale steel dealer in Uttar Pradesh supplies bars and rods to a construction company within the state for, say, Rs 100, the dealer would charge CGST of Rs 10 and SGST of Rs 10, in addition to the basic price of the goods. The wholesaler would be required to deposit the CGST into a central government account and the SGST into the account of the state government. “Of course, he need not actually pay Rs 20 (Rs 10 + Rs 10) in cash, as he would be entitled to set­off this liability against CGST or SGST paid on his purchases (say, inputs),” said the FAQ This is where implementation challenges arise, as former ICWAI president Raghu explained. Every invoice from buyers and sellers must be entered in the GST system correctly to ensure that benefits accrue down the chain. “We have a system today across a majority of small units where an accountant comes (in) once a month, makes vouchers and inputs details for taxes,” said Raghu. “That will have to end now because we are moving to an online, almost real­time system that will need a lot of manpower.” The finance industry is ready by training its professionals, said Raghu, who predicted many job opportunities over the next 5­6 years. But, as he added, it would take at least 12 to 18 months for the system to “settle down”. “I do see a lot of CAs and other finance professionals being trained for indirect taxes in the coming years,” he said.

GST - Ideal, but what is implemented-NDA-UPA

Industry and Banks are not ready for GST implementation[6]: India’s industry and its banking system will have to change systems, train personnel and accept the extra workload for the new taxation system. The banking system has clearly said it is not yet ready. Industry is ambivalent. “Nearly 50 per cent of Indian businesses are not aware of the changes that GST will usher in,” Bharat Goenka, Managing Director, Tally Solutions, was quoted as saying in the Economic Times on June 5. Tally accounting software is widely used by Indian companies. The company is waiting for the GST rules to be finalised, so that it can roll out its GST software for Indian companies. A senior official of Federation of the Indian Chambers of Commerce and Industry (FICCI), requesting anonymity because the launch date was close, said GST was “now a fact”, and industry was trying to adapt. FICCI has been conducting awareness sessions among industry verticals to help understand the new structure, he added The industrial sector, especially the services sector, is waiting for more clarity on tax rates, processes and the time frame for the systems to settle down. “What we still don’t know is which tax slab we fall in,” a marine service provider operating in Goa told IndiaSpend, on condition of anonymity. “While it is good that the taxation system will be streamlined and we will not have to deal with multiple tax payments like excise, service tax and value added tax, we still don’t know how much time it will take for everybody to be on board.” (In arrangement with IndiaSpend.org, a data­driven, non­profit, public interest journalism platform. Though Kerala is one of the few states where cow slaughter is not banned, animal lovers said “such brazen acts” glorify cruelty towards animals and demanded action against Youth Congress activists. The BJP, which is trying to gain a toehold in the state and won its first seat in the last year’s assembly election, also criticised the slaughtering of the animal at a busy market in the heart of Kannur while the Congress asked its cadres to use restrain during protests. BJP state president Kummanam Rajasekharan tweeted the video of the slaughter, saying it was the “cruelty at its peak”. Youth Congress activists defended their move, saying it was a natural form of protest. “The Centre is denying food to the people, it is the biggest cruelty,” Youth Congress leader Rejil Makutty said. Police registered a case against Youth Congress activists who slaughtered a cow in public and cooked its meat. They were booked under IPC Section 428 and section (ii) of the PCA Act 1960.

Country’s Rs 1 lakh-crore meat industry or BJP’s alleged Hindutva agenda: The Centre’s decision, which will hurt millions of poor farmers and squeeze supplies to the country’s Rs 1 lakh-crore meat industry, is being seen as a move to push the BJP’s alleged Hindutva agenda. Cows are considered holy by many Hindus, and have gained in importance since Prime Minister Narendra Modi stormed to power in 2014 with several BJP-ruled states enacting strict laws to punish cow slaughter. As protest mounted in the state, chief minister Pinarayi Vijayan shot off a letter to Prime Minister Narendra Modi, saying the Centre couldn’t draw up a menu and change the food habits of people. “Today it is saying you can’t eat beef, tomorrow it can say no to fish also. We will not allow this to happen in our state,” the CM said, adding the decision would leave many people jobless. The state government is talking to legal experts to challenge the notification. Many of the ruling CPI (M) leaders come from Kannur, where the Left party is involved in a bloody turf war with the Rashtriya Swayamsewak Sangh, the ideological parent of the BJP. In Kerala at least 500,000 people are directly or indirectly involved in cattle trade, slaughterhouses and allied areas. According to the state animal husbandry department data, 117,000 adult cattle and 70,000 young cattle were slaughtered in Kerala in 2016 where beef accounts for 60% of the total meat consumed. Since most of the cattle come from the neighbouring Tamil Nadu and Karnataka, Kerala meat traders fear that the new notification will embolden Hindu fringe outfits and hit supply leading to a shortage of meat in the state. Cow slaughter and smuggling are banned in most parts of the country but there are no curbs on buffalo meat, which is eaten widely as a cheap source of protein. But the new norms will also hit buffalo meat, which goes by different names globally and is also referred to as beef in India, a reason enough for the so-called cow protectors to assault people or even force shut down of eateries.

Muslims would be the worst affected, because of the restriction: The government has banned the sale of cows and buffaloes for slaughter through animal markets, rules that will hurt millions of poor farmers and squeeze supplies to the country’s meat industry, thus the media too started propaganda[1]. However, it has been cautious enough to tell the fact, “The new rules do not amount to a blanket ban on cattle trade or their slaughter, and license breeding remains legal”[2]. But the move will crimp supplies to the country’s Rs 1-lakh crore meat and allied industries which sources about 90% of their requirements from animal markets. The worst hit, however, will be the mostly Muslim meat and leather traders who face mounting violence by increasingly assertive cow vigilante groups. Farmers will also be hit because they will be deprived of a traditional source of income from selling non-milch and ageing cattle.

The new procedure introduced fir the sale of cattle for slaughter: The central regulation for cattle business notified this week allows only farmland owners to trade at animal markets. The notification covers bulls, bullocks, cows, buffaloes, steers, heifers and calves, as well as the camel trade. To be implemented in the next three months, the move introduces lots of paperwork for cow traders who are mostly poor and illiterate. For instance, before the trade, both seller and buyer will have to produce identity and farmland ownership documents. After buying a cow, a trader must make five copies of proof of sale and submit them at the local revenue office, the local veterinary doctor in the district of the purchaser, animal market committee, apart from one each for seller and buyer. “Take an undertaking that the animals are bought for agriculture purposes and not for slaughter,” reads a directive to committees overseeing animal markets in the rule notified under the Prevention of Cruelty to Animals (PCA) Act of 1960 that gives the Centre powers over animal welfare. The new rules were approved by former environment minister Anil Madhav Dave before his death last week, ministry sources told HT. The ministry drafted the rules on Supreme Court directions aimed at improving condition of animals in these markets. Considered holy by many Hindus, cows are a sensitive political topic and have gained in importance since Prime Minister Narendra Modi stormed to power in 2014 as several BJP-ruled states enacted strict laws to punish cow slaughter. But many say the expanding protection for bovines is a proxy war against Dalits and Muslims – as exemplified by the lynching of dairy farmer Pehlu Khan in Rajasthan in April or the flogging of Dalit men in Gujarat’s Una last year. Slaughter of milch cows is banned in all states except in Kerala and in parts of north-east India.

Kerala officially opposing the new law on “cattle business”: The Union government’s new notification banning the sale of cows and buffaloes for slaughter is a “fascist and anti-federal move” and the Centre can’t prepare a menu for the people of the country, Kerala’s Left government said on 27-05-2017, Friday[3]. “We will not allow the (central) government to enforce fascist policies of the RSS and other fringe outfits. Let it issue many such notifications, we will not follow them,” said Kerala’s agriculture minister VS Sunil Kumar. The Kerala Chief Minister’s Office also criticised the slaughter ban[4], saying “Cattle slaughter becomes illegal at a time when manslaughter happens in the name of cow”. In a series of tweets, it said, the new regulation “will rob lakhs of jobs, cripple leather industry”. It called the notification an “attack on our poor, dalits & farmers”. The CMO said food consumption of millions of people will be affected by the “clear attack on our plurality, the essence of India”. The Congress also criticised the Union government’s latest notification.

The introduction of law coincided with Ramzan and therefore against Islam: “It is against the Constitution of the country and infringes upon the right of citizens,” said MM Hassan, acting president of the state Congress. He said the timing of the notification makes it more intriguing, as the Muslim holy month of Ramzan was scheduled to begin on Friday. In Kerala, around 60% of the total meat consumed is beef. Not just Muslims and Christians, many Hindus are also fond of dishes made of the red meat. A raid by Delhi Police at the Kerala House kitchen in the national capital a couple of years ago had triggered outrage in the state. Many student organisations had conducted ‘beef festivals’ in protest against the police action. People in many states in the north-east also eat beef. “It is a very bad decision. We don’t agree to it and won’t implement it,” said Mizoram’s animal husbandry minister C Ngunlianchunga. Mhao, the owner of Taochi Enterprise, one of the biggest meat suppliers in the north-east, said: “I don’t think the rule will be applicable to the north-east. It will be chaotic and a body blow to business. Why are they digging into our plates?” The environment ministry this week notified a regulation under the Prevention of Cruelty to Animals Act, 1960 prohibiting sale of cattle through animal markets across the country. Regulating animal trade is a state business but animal welfare is a central subject, thereby providing the window for the ministry to notify the rule.

DYFI national president Mohammed Riyaz, led the protest: Police in Kannur in north Kerala on 28-05-2017 (Sunday) booked 16 Youth Congress activists who slaughtered a cow in public and cooked its meat and distributed it[1]. The brazen act was committed in front of a huge crowd in Kannur Saturday during the ‘Beef Fest’ held by the Left and Congress parties in Kerala to protest against the Center’s ban[2]. “We will eat beef to show our protest against the central government. We want to tell this to Prime Minister Narendra Modi,” said DYFI national president Mohammed Riyaz, who led the protest[3].  Deccan Chronicle captioned apprpopriately[4], “Youth Congress conducts public cow slaughter in Kerala”, yet Congress has to reckon for the consequences[5]. Actually, how and why one gets an idea of “beaf-fest”, beef-the cow meat eating carnival is thought of and organized immediately? Why the choice of beef and not any other meat or flesh? Thus, the radical elements wanted to show off that it has been a communal protest and not secular or otherwise. An embarrassed Congress sought to distance itself, saying the party will not support anyone who has violated the law, but a Youth Congress activist who led the protest said he had no regrets[6]. They were charged under IPC Section 428 and section (ii) of the Prevention of Cruelty to Animals Act 1960[7]. Several youth groups of the ruling CPI (M)-led LDF and Congress-headed UDF opposition have organised these festivals to protest against the Centre’s recent decision to ban sale and purchase of cattle from animal markets for slaughter, a move criticised by several states. But Saturday (28-05-2017)’s slaughter seems to have backfired.

The CPI(M)-led DYFI and SFI were in the forefront of the protests: “The Hindu” reported as follows: “With every political party barring the BJP coming out against the Central notification banning sale of cattle for slaughter in animal markets, protests erupted in several parts of Kerala on Saturday, many of these places witnessing ‘beef festivals’ organised by student and youth activists. The CPI (M)-led DYFI and SFI were in the forefront of the protests, but the Opposition Congress-led United Democratic Front (UDF) was also in the fray, holding marches, burning effigies and organising public kitchens where beef was cooked and served to activists and passersby[8]. Among those who came out against the Central directive was Congress Working Committee (CWC) member A.K. Antony, who, while addressing a meeting to mark the 53rd death anniversary of Jawaharlal Nehru, called upon party workers not to attach any importance to the Central notification and ‘tear it and throw it into the dustbin’[9].

  • In Thiruvananthapuram, the agitation was led by the DYFI and SFI. Addressing activists, DYFI national president Mohamed Riyaz said, “We will cook beef and eat beef and also protest against the Central government. That is what we want to tell Narendra Modiji.”
  • In Kochi, the DYFI-SFI activists were joined by Tourism and Cooperation Minister Kadakampally Surendran and CPI (M) district secretary and former Rajya Sabha member P. Rajeev, who partook in the beef festival, the former accusing the Central government of cutting at the very root of people’s right to eat what they wanted. Youth Congress activists also took out a march against the Central measure.
  • At Kannur, Youth congress activists publicly butchered a cow to protest against the central notification while in Thodupuzha in Idukki district, protesters took out a march with the head of a buffalo[10].
  • In Kollam, Congress activists led by District Congress Committee (DCC) president Bindu Krishna cooked beef in front of the DCC office. The Centre, she said, had no right to interfere with the livelihood of lakhs of people. “This is nothing but a intrusion into the fundamental rights of the citizens of this country,” she said[11]. Ironically, this lady also participates in Bhagawati Amman festival to boil Pongal! So the Kerala secularism works differently. She may talk about Gandhi giving discourse about non-violence and also cook and eat beef.

How long the antics, gimmicks and tricks could go on by the radicals and ideologists?: “Beef-fests are held to protest ban on sale of cattle for slaughtering cow in Kerala market” says news report[12]. The sale of cattle, cow-slaughter, sale of meat are different aspects, but, they try to confuse all without reading the Act properly[13]. In Tamilnadu, the DK used to perform “Unnum vradham” (eating penance) in front of or against the persons, who are engaded in “Unna vradham” (fasting)! Here, in Kerala, “the Go’s own country” and with 100% literacy, beef-eating festivals are held live not against any “non-beef eating festivals”, as if all meats are eaten, but, beef is not eaten. None would engage in prostitution, if prostitution is banned or restricted or regulated. I do not find anyone who protests against “closure of wineshops” drink! Therefore, if the CPIM and Mohammedan groups start doing antics of cooking beef on the roads, they can do all on the roads as a part of their demo. Perhaps, they want to repeat what the British tried to do that resulted in 1857. In other worrds, they are trying to create tension between the groups and start run rioting. With the ideological expertise and the subversive activities, they are capable of doing that.

Rahul condemn beef eating

Congress caught into dilemma of Cow-slaughter politics: Congress leader Mahathma Gandhi had been against Cow-slaughter and promoter of “Ramrajya”. However, Sonia Congress has become “secular” with the Mohammedan and Christian support. Sonia herself is seen as “Christian” and foreign by many Indians, though, rarely such views are publicized. Sharad Pawar, Jayallita and others openly named her as “Sonia Maino”. Recently, in UP, Congress badly lost its political power, with the rise of BJP with more than absolute majority. Thus, definitely, Congress cannot pay heavy price in this issue. Congress vice president Rahul Gandhi on Sunday condemned the public slaughter of a calf in Kerala by Youth Congress workers and said the party did not support it[14]. “What happened in Kerala yesterday is thoughtless, barbaric and completely unacceptable to me and the Congress Party. I strongly condemn the incident,” Rahul said in a tweet[15]. Kamudi another local daily dubbed Rahul saying that youth congress members are brainless[16]. Whether they would be thoughtless or brainless[17], they had obviously colluded with the other radical elements of Kannur. Evidently, he was advised to do so, as otherwise, the Congress could loose whatever support it has in the “cow belt”, as now, it has lost ground there. Thus, in a face saving manner, the comdemnation has come from him, instead of Sonia Gandhi, the President![18]

Hyderabad church attacked

Why local people should have objected to the building of Church?[1]: “The Special Correspondent” always not named of “The Hindu” characteristically reported as follows: “The church consecrated on May 13 by the Archbishop of Hyderabad Reverend Thumma Bala came under attack after a mob of locals reportedly entered it….. The miscreants, it was understood, had earlier gathered at the gram panchayat office, where a meeting was held opposing the continuation of the church……. The mob was led by the village sarpanch, said the police. “The irate villagers claimed that the owner of the land had illegally built the church. We have booked them for rioting,” Inspector M. Surender said, adding that they were yet to name people in the case[2]. The inspector also said George Reddy, the owner of the land who had allocated about 1,000 square yards for the church, had applied for permission for constructing a church with the district administration but had not received approval yet[3]. So why, they did not answer the issues connected?:

  1. Who are the miscreants not named?
  2. Why they opposed the building of Church?
  3. The opposition started immediately, yet, the Christians have been adamant enough to continue to violate the law and wishes of the local people.
  4. The miscreants, it was understood, had earlier gathered at the gram panchayat office, where a meeting was held opposing the continuation of the church…….”., thus, it is revealed through the Hindu report.
  5. …….The mob was led by the village sarpanch, said the police. “The irate villagers claimed that the owner of the land had illegally built the church.” Then, how and why the Bishop came there consecrate?
  6. Do all these Christians from Bishop to the nominated MLA in Telangana Assembly Elvis Stephenson and national coordinator of the Disaster Management wing of the All India Catholic Union Roydin Roach, want to legitimatize their illegal acts under the guise of Christianity, minority or some other reason?
  7. “The irate villagers claimed that the owner of the land had illegally built the church. We have booked them for rioting,” Inspector M.”- good, but, what about the violators of the law of this land? How they are superior to the villagers? Why no action was taken agaist George Reddy or the Bishop who wanted to justify the illegal acts?

Elvis Stephenson connected with Church and political activities: Though, one is not interested in the affairs of others, but, when they try to poke their noses with vested interests, naturally, the other would try to probe why they are poking their noses. When started verifying with the persons involved in the church building affairs, there have been a lot of controversies, accusations and arrested involving politics and Christian religious leaders. The reported in 2015: “Police are verifying the reported statement of Telangana nominated MLA Elvis Stephenson made before the Magistrate in the cash-for-vote case, that Bishop Harry Sebastian had connected him to A.P. Chief Minister N. Chandrababu Naidu over mobile phone[4]. The statement indicated that Sebastian had called up Stephenson three to four times assuring to put him through Mr. Naidu over phone. Around 4 p.m. on May 30, 2015 he Bishop rang up on mobile phone No. 9949054322 of the nominated MLA and connected him to Naidu. Five hours later, Sebastian gave a ring to him and passed on his new mobile phone number, sources said. The next morning, he rang up again and conveyed that he (Sebastian) along with TDP MLA A. Revanth Reddy would come to his house and hand over Rs. 50 lakh out of the Rs. 5 crore assured to be paid to cast vote to the TDP MLC nominee. But Sebastian later decided to change the place of meeting. Then the nominated MLA approached his friend Malcolm Taylor stating that he wanted to meet some people at the latter’s house. However, the meeting was arranged at the house of Taylor’s mother. The ACB officials had set up audio and video recording equipment in the house. Elvis Stephenson had told the Magistrate that Bishop Harry Sebastian had connected him to Naidu over phone”[5].  So, one should not not involved in such controversies, if he has been truly religious and worried about God! But, the events show that they have been more interested in other affairs and activities also.

Bishop Sebastian Harry arrested in cash-for-vote scandal involving Elvis Stephenson[6]: It appears that the Christian MLA was involved in controversies also. The Hyderabad High Court on Friday [03-06-2016] quashed an FIR filed against Jerusalem Mathaiah, an accused in the cash-for-vote scandal involving TDP MLA in Telangana A Revanth Reddy. Mathaiah, whose name figures as the fourth accused in the case registered on May 31, 2015, by Telangana’s Anti-Corruption Bureau, had moved the court seeking quashing of the FIR. On May 31 last year, TDP’s deputy floor leader in Telangana Assembly Revanth Reddy and two others Bishop Sebastian Harry and Uday Simha were arrested by ACB while allegedly paying a bribe of Rs 50 lakh to Elvis Stephenson, a nominated MLA, for supporting TDP nominee Vem Narendar Reddy in Legislative Council elections on June 1, 2016. TDP MLA Sandra Venkata Veeraiah was also arrested later. All of them were subsequently granted bail. Mathaiah had secured a High Court order staying his arrest. He had sought quashing of the FIR on the ground that at no point he had had any conversation with Stephenson and the link was not established between him and Revanth Reddy[7]. Justice B Siva Sankara Rao allowed his application and quashed the FIR against him. In spite of all these happenings, KCR samctioned Rs. 5 crores for building church buildings and Elvis Stephenson thanked him appreciating[8]. These are mentioned not for raking up old issues or settled matter among the involved Christian leaders and politicians, but, as they accuse Hindus of “extremism” and all, then, their nature has also to be subjected to scrutiny.

Andhra, Telengana, Church building and Communalization of society: When Samuel Rajasekhara Reddy was there, he was openly accused of helping Christians to build churches all over AP. Incidentally, the AP people openly told that he was punished by the God Venkateswara, as he allowed Christians even to encroach Titupati and Tirumala by building Church and distributing propagandist materials denigrating Hindu religion. Now, Telengana state has been created much against wishes of Telugu speaking people, but, just to satisfy the personal interests of KCR and his associates. As he has been communalizing Telengana, he has been hobnobbing with the fundamentalist Muslims and Christians going on granting funds and other facilities officially. Thus, these fundamental groups have been emboldened to engage themselves in communal agenda. In doing so, naturally, they have started rubbing the feelings of Hindus. Here also one can carefully note the tone and tenor of the Christian leaders speaking against Hindus. They have been allowing SC converted Christians to continue as Hinds only, as otherwise, they would loose the reservation benefits. At the same time, when the Christians get benefits, they are not percolated to the converted Christians. With a lot of misappropriation of funds, sex scandals involving Bishops, pastors etc., they have been perhaps indulged in this type of mudslinging, creating controversies and inciting violence through illegal activities. Therefore, it is better to check these vested groups, instead of accusing “ordinary people” and so on!
