, Sabarimala -the Five judges

The split judgment of Sabarimala and the haste politics of Communists leading to complications: The Supreme Court has announced that women of all ages could enter Sabarimala Iyyappan Temple in its judgment delivered on September 28, 2018. It has been a split judgment, as one of the five judges differed with the others[1]. Evidently, the Supreme Court or the four judges have not gone into the details of the temple, its tradition and connected rituals. Also, they have not considered the other provisions of the Constitution, where, various religious sects and denominations could maintain their own temples, belief system etc., without affecting others. That Sabarimala temple and devotees have been maintaining their position for hundreds of years has been proven by its existence and continuing traditions. As this has been the condition, the scene created, definitely by few, has been condemnable, as Sabarimala is not a place of picnic, activism or politics.Therefore, the few women, that too, non-Hindus, journalists and TV crew to go there and create problem, affecting the devotees, who have been going there with the vow, proves the pre-planned attack on the Sabarimala devotees, under the guise of law. Evidently, the Kerala government, now headed by the Communists have stated exploiting it as an opportunity to disturb and wound the sentiments of the devotees, by applying the police force, as evident from the happenings.

Sabarimala movement has given space for all: Sabarimala movement, in the sense, that it gives equality to all without any discrimination, particularly for men, has been grown phenomenally, attracting many. Of late, rich people, actors and others started going there. Generally, poor people, labourers, workers, auto drivers and others used to go there, as they used to start their nonbu / penance during Kartigai month. Thus, it is very much similar to Varkari movement that drew lakhs of devotees spontaneously[2]. During their vow period, they do not take non-veg food, drink, smoke etc., and thus, they follow “brahmacharya” as a “kannisami” viz. young male devotee of virtues. They feel pride, as all others call them as “Sami” with respect. Of course, young and old women going there has been a regular feature and none took it differently……Thus, all have been going on well for so many years, but, in 2018, it has become a big issue. Ironically, instead of real woman-devotees, as they respected the tradition and do not want to violate, in spite of the judgment, few non-Hindu women, that too, journalists tried to enter with police force affecting the sentiments of crores of Hindus. How many of Indians would have red 411 pages judgments is also not known.

It is not dissent judgement, but, people’s judgment: The Judge, Indu Malhothra, has summarized her order as follows: “The summary of the aforesaid analysis is as follows:

 

(i) The Writ Petition does not deserve to be entertained for want of standing. The grievances raised are non-justiciable at the behest of the Petitioners and Intervenors involved herein.

 

(ii) The equality doctrine enshrined under Article 14 does not override the Fundamental Right guaranteed by Article 25 to every individual to freely profess, practise and propagate their faith, in accordance with the tenets of their religion.

 

(iii) Constitutional Morality in a secular polity would imply the harmonisation of the Fundamental Rights, which include the right of every individual, religious denomination, or sect, to practise their faith and belief in accordance with the tenets of their religion, irrespective of whether the practise is rational or logical.

 

(iv) The Respondents and the Intervenors have made out a plausible case that the Ayyappans or worshippers of the Sabarimala Temple satisfy the requirements of being a religious denomination, or sect thereof, which is entitled to the protection provided by Article 26. This is a mixed question of fact and law which ought to be decided before a competent court of civil jurisdiction.

 

(v) The limited restriction on the entry of women during the notified age group does not fall within the purview of Article 17 of the Constitution.

 

(vi) Rule 3(b) of the 1965 Rules is not ultra vires Section 3 of the 1965 Act, since the proviso carves out an exception in the case of public worship in a temple for the benefit of any religious denomination or sect thereof, to manage their affairs in matters of religion.

 In light of the aforesaid discussion and analysis, the Writ Petition cannot be entertained on the grounds enumerated hereinabove. It is ordered accordingly”, thus, passed the judgment. Hence, it is not any dissent judgment, but, people’s judgment and perhaps, God’s judgment!

With obvious politicization of the issue, the Temple authorities and the Kerala government have decided not to appeal against or file revision petition. Contrary, the Hindus of Kerala have started their protests in a large scale in peaceful manner. Thousands of women came on the roads and marched towards Government offices with the pictures of Ayyappa and banners questioning the judgment that affects their devotion and tradition. On 03-10-2018 [Wednesday], more than 20,000 devotees marshalled through social media, mostly women, held a protest march in Pandalam, headquarters of an erstwhile royal family that once governed the temple. The leading Malayalam daily, Malayala Manorama, carried a front-page picture of the march but Mathrubhumi came under attack for carrying a report on an inside page and without a picture. About the downplying of this event the media groups themselves were divided, because of the government pressure[3]. The entry of Nair Service Society (NSS), a socio-culture organisation of the influential upper-caste community has only added steam to the protests. The NSS also happens to be the first to decide on filing a review petition against the judgement[4]. As usual, the ruling Communist and Congress parties started accusing BJP, RSS and other right wing organizations for such upsurge, but, the fact has been different, as the Left wing media groups have been heavily anti-Hindu affecting the sentiments. Thus, ironically, the few women Mohammedan, Christian and secular categories came and started the communalization of the issue. These have been the credentials and back ground of the women who started creating problem.

L. S. Libi atheist posing as a devotee with dress!: The NDTV reported that[5]C.S. Libi, Christian posed as a Hindu, was among the first to attempt the trek to the shrine on the day the temple gates were to open. Days before her visit, she had posted her plan on Facebook. The protesters had apparently seen her post and decided to block her the moment she reached a bus stand in Pathanamthitta, 65 km from the temple. The police had shielded her from a group of protesters who had surrounded her at the bus stop. They threatened to burn the bus if it drove towards the temple’s base camp, news agency IANS had reported.” But, the event was videographed ny many and she had to return, because of her contradicting answers and encounter she had with women devotees and others at the bus-stand[6]. Another woman, Libi CS, was arrested at a bus stop by worshipers who accused her of wearing jeans[7]. “This is how a lady should go to the temple.” She claims to have observed penance, but if you look at the pearls of the Sabarimala necklace, it is very clear that she has worn it today. “Yesterday or yesterday, it is not acceptable to us and she will not be allowed to go there,” said a group of angry female protesters. Libi CS, a journalist, posted on Facebook her plan to visit Sabarimala Temple. The protesters apparently saw her post and decided to block her as soon as she arrived at a bus station in Pathanamthitta, 65 meters from the temple. “Friends, we are leaving all four for Sabarimala today, which includes atheists like me and two devotees,” said Libi’s Facebook message[8].

Ibrahim posing as “Siva” developed Fracebook friendship with a 13-year school girl: Accepting what seemed like an innocuous Facebook friend request ended up in a nightmare for a a 13-year-old girl from Tirupur, as the friendly stranger turned out to be a sexual predator, facebook friend for just few months, who ensnared the young teen and raped her. A 22-year-old man and a lodge manager were arrested on 01-05-2017 Monday on charges of raping a 13-year-old 8th standard schoolgirl. The man, who befriended the girl from Tirupur on Facebook, took her to Puducherry, raped her and abandoned her in a lodge. Later, the lodge manager also raped her. The arrested persons were identified as S Ibrahim, 22, of Pichampalayampudur in Tirupur and E Prabhakaran, 29, of Puducherry[1]. Police said Ibrahim was working in a textile unit in Tirupur and Prabhakaran had taken a lodge on lease more than six months ago[2].

The girl eloped with Ibrahim as he talked so sweetly: Lured by the 21-year-old youth’s sweet-talk, the teenager ran away with him to Chennai and then to Puducherry, where she was sexually abused for two days[3]. It is ridiculous that that the 13-year girl could be so bold enough to elope with a stranger from Tirupr to Chennai to Puducherry and accepted to stay in lodge. The girl’s harrowing tale came to light on April 29, 2017 when she reached Tirupur two days after she went missing and narrated her ordeal to her parents[4]. On April 27, the girl’s parents lodged a complaint with the Tirupur North police claiming their 13-year-old daughter had gone missing. But, what the parents were doing about her activities with phone, facebook friendship, strange behaviour and other activities. They must have watched her. Even as the sleuths were trying to trace her whereabouts, she returned on her own two days later. What the girl had to tell about the two days away from home swung the city police into action, leading to the arrest of a 21-year-old youth from Chennai and a 27-year-old man from Puducherry. Police said the girl became friends with Siva (21) on Facebook recently. Over time, Siva talked her into eloping with him and on April 27, he reached Tirupur. The girl gave her family members the slip and eloped with Siva to Chennai. After a brief stay there, Siva took her to a lodge in neighbouring Puducherry, where he allegedly raped her for two days. Ironically, though TOI mentions his name as Ibrahim, Indian Express does not, perhaps on the principles of “Secular journalism”!

The lover sold her gold chain and vanished: Later, Siva sold her gold chain weighing one sovereign, gave her the return fare to Tirupur and vanished. Really, it is interesting and intriguing to note as to how the girl could giv her chain also to the crook after all these happenings. Ibrahm should be interrogated thoroughly and his modus operandi should be ex;posed, so that the girls could be safe. Finding the girl all alone, lodge owner Prabakaran (27) befriended the girl under the guise of helping her reach Tirupur. After realising what had happened, Prabakaran too allegedly sexually abused her[5]. The girl managed to escape from the lodge and reach Tirupur with the money Siva had left her. After hearing her tale, a team of sleuths traced Siva to Chennai and arrested him on 01-05-2017 (Monday) on charges of kidnapping and raping a minor girl[6]. Another team nabbed Prabakaran from his lodge in Puducherry. Both the accused have been booked under various sections of the Indian Penal Code and the Protection of Children from Sexual Offences Act (POCSO). After all these happenings, the media started disciurse on “online sexual grooming” and so on!

Online sexual grooming – definition and so on![7]: Child grooming is generally understood as the practice of befriending and forming an emotional bond with a child by a person with the objective of sexual abuse. According to the Oxford English Dictionary, the word ‘grooming’ was first used in connection with a paedophile in a 1985 story by Chicago Tribune which stated, “These ‘friendly molesters’ become acquainted with their targeted victim, gaining their trust while secretly grooming the child as a sexual partner.” Child grooming incidents have increased with the advent of the internet, where such incidents are increasingly taking place online, through public chatrooms and social media. In India too, such instances have been reported in the past[8].

  1. Last year, two teenagers were arrested in Kolkata for kidnapping and rape of a 15-year-old girl whom they had befriended on Facebook.
  2. Another instance of online grooming was reported in December 2016 where a teenage girl was raped by a Facebook friend in Mumbai.
  3. More recently, in January 2017, a minor girl in Cuttack alleged rape by a boy whom she had met through a social networking site.

With the proliferation of smartphone users in India, child grooming incidents can only be expected to rise in future.

Tulir’s discourse on Online sexual grooming[9]: As usual after some days, the analysis comes  in this way: “This is a classic case of sexual grooming,” says Vidya Reddy, of Tulir, Centre for Prevention and Healing of Child Sexual Abuse. “Abusers study a situation carefully to understand what a child’s Achilles heel is and then exploit the situation. Now, with almost every child having accesses to technology and internet in the form of a laptop or phone, these criminals have found new platforms to target children,” she adds. What Vidya explains is called online sexual grooming, a worldwide phenomenon, that has spread along with the speed and easy access to the internet. According to UNICEF, it can be defined as preparing a child or adult for sexual abuse, exploitation or ideological manipulation. A report released by the organisation in 2014 states that the surge in mobile and internet usage in India had brought 400 million people online. Of this, seven percent of internet users in the country are reportedly children. “Phones are now an extension of our hands and it has completely changed the way crime is committed and presented,” Vidya notes. Even a report of the Parliamentary Committee on Information Technology in 2014 recognized the threat posed to children by predatory paedophiles online. It emphasises how these predators “conceal their true identity whilst using the internet to ‘groom’ potential victims for sexual purposes.”

From home to horror[10]: The girl, Meena [name changed] too was unaware about the identity of the person she was chatting with. In fact, an officer told The News Minute, that it was only when Ibrahim called her on the phone that she even realised she had compromised all her data to an unknown man. But Ibrahim, as the police put it, was too smart for the girl. “He spoke to her very nicely and formed an emotional connect before she even realised the dangers of the situation,” a police officer told The News Minute. “He was just somebody who did odd jobs for a living but his real life was on Facebook. He has close to 5000 friends and they are all young girls,” she admits.

What parents and others should do?: As the issue has bee n so simple and as well as complicated in modern times, the following are suggested,  though, the modern ones might object on the grounds of “moral-policing” and so on:

  1. In schoools, moral education classes should be introduced naking them understand, realize and appreciate the moral values of family, parents, relations, respect to elders and connected issues.
  2. Of course, parents and elders should set example to their children, boys and girls and others.
  3. The studying teenage boys and girls should concentrate in studies and not in love, love-making, sex related topics.
  4. The cinema, TV, print and electronic media and connected persons should have some sort of “Social respinsibility” in their presentation of ads, news, serials etc.
  5. They should avoid negative suggestion, instread, present wth positive asppects giving good examples.
  6. Definitely, parents should watch the activities of their children, boys and girls carefully.
  7. Their extra-cautious activities should be monitored with the time-spending, money-requirement and spening, goingout on various pretexts etc.
  8. That teens from slums could kidnap and enjoy life with rich girls, autowalas, coolies and others also could join sucg fray to get girls just by wearing jeans, riding a bike, and such other iditic myths should not be promoted.
  9. The cine songs, depiction etc, should have some decency and decorum, instead of portraying the dancing actresses as whores, or they would go with anybody and indulge in sex immediately.
  10. The law enforcing auhtorities can monitor all these activities.

“Barbaric crimes should definitely attract barbaric models of punishment”[1]: In a strongly-worded order, the Madras High Court had earlier this month recommended castration as punishment to child sex abusers observing that “barbaric crimes should definitely attract barbaric models of punishment”[2]. Justice N Kirubakaran, in a recent order against a British national, made the recommendation to the Centre saying that castration would achieve “magical results” in preventing child abuse. “When law is ineffective and incapable of addressing the menace, this court cannot keep its hands folded and remain a silent spectator, unmoved and oblivious of the recent happenings of horrible blood-curdling gang rapes of children in various parts of India,” he said[3] castration for child rapists would fetch “magical” results in preventing child abuse. The judge said this while dismissing a petition by the accused, a British national, who sought the quashing of the proceedings against him in a lower court. The judge further said that “though the suggestion of castration looks barbaric, barbaric crimes should definitely attract barbaric models of punishment” and the very thought of the punishment should deter the culprit from committing the offence. Anticipating a reaction to his judgment, he said: “Those activists should first exhibit sympathy with, and support to, the victims of such crimes by visiting and consoling them at the hour of crisis instead of having misplaced sympathy with the perpetrators under the usual banner of ‘human rights violation’. They must remember that ‘human rights’ is not a term restricted to, and reserved only, for offenders.” He also directed the Union government to decide on introducing compulsory sex education for high school students. “Denying youngsters correct and scientific information would lead [them] to acquire half-baked and incorrect knowledge from other sources, like Internet, friends and movies, creating misconception and doubts.”

The accused paedophile has been from Britain[4]: Taking note of the number of cases of foreigners abusing children, the judge referred to the International Child Protection Certificate (ICPC) developed by the United Kingdom to protect children and said the visa form issued by the Indian Embassy had to be amended with the provision of a column requiring the applicants to give the details of convictions, actions warranting reprimands and impending cases. According to the prosecution in the present case, the British national, had sexually abused a 15-year old student in 2011, after befriending the family by promising the mother that he would support her son’s education. The accused eventually took the Class 9 boy to Delhi, where he allegedly abused the victim, including attempts to have sexual intercourse. After the Briton left for London, with the help of the Justice and Care Organisation, the victim filed a complaint on the incident, following which a case was registered under relevant sections of the IPC and Juvenile Justice Protection Act. After the Judicial Magistrate took cognisance of the case in 2012, following the filing of the final report, the accused moved the court seeking to quash the proceedings against him. Following the issuance of the non-bailable warrant against him, a red alert was issued against the accused by the Interpol. The accused contended that the notice was preventing him from coming to India to defend the case. The judge has dismissed his plea to quash the proceedings against him but stayed the red corner notice so that he can come to India to appear before the trial court and face the case.

The opinion of Abha Singh, social activist[5]: Welcoming the Madras High Court’s suggestion of considering castration as punishment for child rapists, two social activists on 26-10-2015, Monday said that the suggestion made to the Centre was apt as the existing Indian law is unable to protect the child from abuses. “Child abuse cases in India are increasing. The Madras High Court in one such case has come up strongly and said that the Indian law is unable to prevent child abuses. The conviction rate in child abuse cases is barely 2.4 per cent whereas the offences against children have increased by 400 per cent,” social activist Abha Singh told ANI. “When rapists are going scot-free and paedophiles are going scot-free, a Madras High Court judge has rightly suggested that there should be castration. Many other countries like UK, USA, Polland and many other countries subscribe to castration and it has been seen that it has been successful in checking the paedophiles,” she added.

What Pramila Nesargi opined[6]: Another social activist and lawyer Pramila Nesargi echoing similar sentiments expressed her delight with the Madras High Court judge’s suggestion. “I always advocated that castration can be the only remedy because the existing law is not creating any fear in the minds of the people. People may call it barbaric but judge has openly said that barbaric punishment should be given for barbaric crimes,” Nesargi told ANI. However, when such cases were reported earlier, the activists were not responding. In Indian society, the social aberrations have been introduced or created due to external factors, distorting the existing social system and institutions. The offenders have been escaping under the newly created laws with the crimes committed before the enactment.  The sociologists, psychologists and other researchers opine based on these incidences, which are happening in a country with 1.2 billion population. As so many external and internal factors have been disturbing, the people also get affected. Allowing modern evils at one side, supporting them under the guise of  human rights and so on and crying wolf about eroding moral values have been the characteristics of  the commentators on Indian society.

Dilemma of Indian society caught in many social issues: In India, most of the child-rapists or paedophiles have been foreigners. The number of child abuse cases has increased from 38,172 in 2012 to 58,224 in 2013 and to 89,423 in 2014. Incidentally in 2013, at the height of the protests in the capital over the Nirbhaya case, Tamil Nadu chief minister J Jayalalithaa had similarly called for death or chemical castration for rapists through amendments in Central laws[7]. As Bangalore has been prone to foreigners satisfying their needs, issues have been alive in the case of pubs, pub-dancing, soliciting and other activities, which might be viewed and interpreted differently. Of the 51 cases of child abuse under the Protection of Children from Sexual Offences Act in the special court for children in Bengaluru, only four have ended in convictions. More than 90% charged under the Pocso Act are acquitted due to lack of evidence and when witnesses turn hostile[8]. Not that evidences were not there, but, the manipulators could influence the involved processes. As example, it is mentioned that children migrating from Tamil Nadu and northern India to the city are the main victims of child abuse whose cases are tried in the session court. Most of these children live with their mothers and fall prey to step-fathers and other offendes. Most abusers are between 25 years and 50 years. The youngest victim so far is just a year old. But, this could be the situation for all Indian children. The highest number of FIRs has been registered in Rajasthan followed by Maharashtra, Uttar Pradesh, Madhya Pradesh and Kerala according to data available with the National Commission for Protection of Child Rights (NCPCR). The number of convictions is only 166 that is 2.4% of the total cases registered while in 389 cases accused were acquitted[9].

Madras / Chennai has been haven for paedophiles: For inexplicable reasons or otherwise, Chennai has seen many international paedophiles got arrested. The locals have also been aiding and abetting such offenders and promoting social crimes. The manipulation of cyber-space has been revealed in many acts. Child rights activists in Chennai have forced authorities to shut down two Facebook pages in Tamil created to attract pedophiles in May 2015. The pages, called ‘chinna ponnu karpazhipom‘ and ‘chinna ponnu veriyargal’ which in Tamil roughly translates to ‘young girl having sex’, had photographs of young girls with a number of sexually explicit comments.

They were spotted by social activists who immediately contacted the authorities to take it down, CNN-IBN reports[10]. 53-year-old Eric Martin alias Jack Fernandes , convicted for raping nine girls in 1998,  had gained entry into India through Nepal and was staying in Madhavaram in Chennai. He had been on the run ever since he was convicted in France and was on Interpol’s Wanted list[11], but arrested in Chennai on November 17, 2010.

Patrick Matthews, a 62-year-old UK national who was accused of sexually abusing several boys of St George Anglo-Indian Higher Secondary School in the city between 2003 and 2006, has been arrested by the UK police in August 2009. Sources told TOI that the police arrested Matthews from the UK on Thursday night based on evidences collected from Chennai[12]. Wilhelmus Weijdeveld, the 56-year-old Dutch national now in prison facing charges of child sexual abuse and supplying child pornography, had found that India suited him best’ and even filed for citizenship as early as in 1999, thwarting the attempts of the police to drive him away from the country. He even filed a writ petition against the state of Tamil Nadu, after the Mamallapuram police asked him to leave the country. It was only after three years, on May 02, 2002, that he was arrested for sexually abusing five boys in an orphanage near Mamallapuram. Out on bail, Wilhelmus was arrested again from his Choolaimedu den in Chennai on November 7, 2009 following an Interpol tip-off that he was uploading child pornography on the internet[13].  These are given only for illustrative purpose, as many cases have been reported regularly, and most of them been from the orphanages run by the missionaries in and around Chennai. Therefore, the Judge must have been aware of such incidences. Stringent legislation was the need of the hour to penalise child sexual abuse via the Internet, said Chief Justice of India, Justice P. Sathasivam[14], while inaugurating  two day Southern regional conference on Protection of Children from Sexual Offences (POSCO Act, 2012)’, in Chennai, in November 2013.  Therefore, castration as punishment to them, as proposed has been the logical conclusion.
